International law requires that an army hold hearings to determine the status of prisoners, if that status is in doubt- these hearings are called Article 5 Tribunals (of the Geneva Conventions). The US Army has conducted these, although they called them something else in the begging (for idiotic political reasons).
If you are determined to be a prisoner of war you can be held until the war is over. If you are determined to be a war criminal then you can be tried for those offenses separately from your status as a prisoner of war.
The problem with GITMO is that 75% of these people we want to let go- but their home nations will not accept them (or we believe that they will be tortured if released). So what do we do with them? We certainly are not going to let them into the US. The other 25% are hard-core terrorists that will be held until the war on terror is over – unless they get the death penalty in a war crimes tribunal. Either way, it is unlikely that they will ever see freedom.
I agree with Gork. Of course once an enemy surrenders or is injured to the extent that he can no longer fight you have to take him prisoner. I, however, would support aggressive tactics to limit the chances of either one of those events from occurring.

Because it's bullshit. Why hold somebody if they can't be found guilty of anything? It doesn't matter what happened in the past.
Is it purely the motive of sending a message to those who would fuck with America?

I don't know the details of the case, but it's somewhat deflating that the first conviction from the military tribunals is of a servant.

Not necessarily. The prosecutors (and defense) are top notch. The prosecution dictates the order that the trials goes- I suspect that they have a reason for their order. I am not sure how the panel is composed. In a traditional court-martial there would be a master panel seated for at least six months and members are drawn for each court-martial. I am not up on the military commission rules.

military sentences are typically light except for the real hard corps criminals. The judge must have thought that this guy was a putz.
